acetyl-histone H3 should always IP?

Hi,
I'm new in ChIP.
I'm using as positive control the acetyl-histone H3 (upstate 06-599), but it gives me a band only for the stimulated condition.
I don't get any band in the not treated condition.
My inputs are fine.
So, I wonder: should Histone H3 always precipitate and be present on the promoter of a gene even if the gene is not transcriptionally active?

I hope some of you can help me.
